Please read these Terms & Conditions carefully before using 3D Depth Effects Studio. By installing, accessing, or using this software, you acknowledge that you have read, understood, and agree to be bound by these terms.

 

1. Copyright & Ownership

Copyright © 2024-2025 VanyaDoing. All Rights Reserved.

3D Depth Effects Studio (the "Software") and all associated code, algorithms, design, structure, organization, graphics, user interface, documentation, and other intellectual property are the exclusive property of VanyaDoing ("Owner") and are protected by:

  • United States and international copyright laws

  • International copyright treaties

  • Other intellectual property laws and treaties

All title, ownership rights, and intellectual property rights in and to the Software remain with the Owner.


2. License Grant

2.1 Free Plan Users

Limited Evaluation License

Free Plan users are granted a limited, non-exclusive, non-transferable, revocable license to:

  • ✓ Use the Software for evaluation and testing purposes

  • ✓ Display effects on websites using default settings only

  • ✓ Preview and test all effect types in the editor

Limitations:

  • ✗ Custom settings do NOT apply on published websites

  • ✗ No warranty or technical support provided

  • ✗ No commercial use permitted

2.2 Premium License Holders

Commercial Use License

Premium users receive a limited, non-exclusive, non-transferable license to:

  • ✓ Use the Software on authorized websites as specified in the license agreement

  • ✓ Apply custom settings and configurations

  • ✓ Receive priority technical support

  • ✓ Access updates and new features as specified

Note: Premium licenses are site-specific and non-transferable. Each website requires a separate license.

 

3. Prohibited Uses

You may NOT do any of the following without express written permission from the Owner:

  • ✗ Copy, reproduce, duplicate, or republish the Software code

  • ✗ Modify, adapt, translate, or create derivative works

  • ✗ Distribute, share, sell, rent, lease, or transfer the Software

  • ✗ Reverse engineer, decompile, or disassemble the Software

  • ✗ Remove or alter copyright notices, trademarks, or proprietary legends

  • ✗ Use for commercial purposes without a Premium license

  • ✗ Disclose, publish, or share the source code with third parties

  • ✗ Use the Software in any manner that violates applicable laws

  • ✗ Sublicense, sell, or transfer your license to others

 

4. Confidentiality & Trade Secrets

The Software contains proprietary algorithms, trade secrets, and confidential information belonging to the Owner. By accessing the Software, you agree to:

  • Maintain the confidentiality of all source code and technical documentation

  • Not disclose, publish, or disseminate any portion of the Software to third parties

  • Take reasonable measures to protect the Software from unauthorized access

  • Immediately notify the Owner of any suspected unauthorized use or disclosure

 

5. Intellectual Property Rights

This License does not grant you any rights to:

  • Trademarks, service marks, or trade names of the Owner

  • Patents or patent applications related to the Software

  • The "3D Depth Effects Studio" name or branding

  • Any other intellectual property not explicitly granted herein
     

6. User Responsibilities

You are responsible for:

  • Ensuring your use complies with all applicable laws and regulations

  • All content created using the Software

  • Maintaining the security of your Premium license credentials (if applicable)

  • Any consequences resulting from unauthorized sharing of your license

 

7. Updates & Modifications

The Owner reserves the right to:

  • Update, modify, or discontinue the Software at any time

  • Change pricing for Premium licenses with notice to existing customers

  • Modify these Terms & Conditions (changes become effective upon posting)

Continued use of the Software after changes constitutes acceptance of updated terms.
 

8. Termination

This License is effective until terminated. Your rights will terminate automatically without notice if you:

  • Fail to comply with any term of this License

  • Violate any intellectual property rights of the Owner

  • Engage in any prohibited use listed in Section 3

Upon termination, you must:

  • Immediately cease all use of the Software

  • Destroy all copies of the Software in your possession or control

  • Remove the Software from all websites and applications
     

9. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.

The Owner explicitly disclaims all warranties, express or implied, including but not limited to:

  • Implied warranties of merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Accuracy, reliability, or completeness

The Owner does not warrant that:

  • The Software will meet your requirements

  • The Software will be uninterrupted, timely, secure, or error-free

  • Results obtained from the Software will be accurate or reliable

  • Any errors in the Software will be corrected
     

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

The Owner shall NOT be liable for any:

  • Direct, indirect, incidental, special, or consequential damages

  • Loss of profits, revenue, data, or business opportunities

  • Business interruption or loss of business information

  • Cost of substitute goods or services

  • Damages arising from your use or inability to use the Software

This applies even if the Owner has been advised of the possibility of such damages.

Maximum Liability: In no event shall the Owner's total liability exceed the amount paid by you for the Premium license (if applicable) in the 12 months preceding the claim.
 

11. Indemnification

You agree to indemnify, defend, and hold harmless the Owner from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

  • Your use or misuse of the Software

  • Your violation of these Terms & Conditions

  • Your violation of any third-party rights

  • Content you create using the Software
     

12. Legal Action for Violations

IMPORTANT: Unauthorized use, copying, modification, or distribution of this Software may result in:

  • Immediate termination of your license

  • Severe civil penalties and monetary damages

  • Criminal prosecution under applicable laws

  • Injunctive relief to prevent further violations

  • Recovery of attorney's fees and court costs

The Owner will pursue all violations to the maximum extent possible under the law.
 

13. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which the Owner resides, without regard to conflict of law provisions.

Any disputes arising from these terms shall be resolved in the courts of that jurisdiction, and you consent to the personal jurisdiction of such courts.
 

14. Entire Agreement

These Terms & Conditions, together with any Premium license agreement you may have with the Owner, constitute the entire agreement between you and the Owner regarding the Software and supersede all prior agreements and understandings.
 

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
 

16. No Waiver

The Owner's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

BY INSTALLING, ACCESSING, DOWNLOADING, OR USING THE SOFTWARE, YOU ACKNOWLEDGE THAT:

  • You have read and understood these Terms & Conditions

  • You agree to be bound by all terms and conditions

  • You understand the prohibited uses and consequences of violations

  • You accept the disclaimers and limitations of liability
